Step Therapy/First Fail Legislation Officially a Law in NY!
On Dec. 31, Governor Andrew Cuomo signed legislation that would implement patient protections in step therapy protocols. The bill, #S3419c, would require health insurers in NY state to provide accessible and expedient means for patients and physicians to appeal step therapy protocols. It also lists instances when an exemption from step therapy should be granted; including when the insurer-preferred drug is contraindicated for the patient, the drug is expected to be inefficient, or the patient is already stable on a provider-prescribed drug. This bill is a win for patients and protects the shared decision-making between a patient and their physician. Congratulations and thanks to everyone that contacted their legislators and the Governor in support of #S3419c.
